By accessing or using this website (movies.harikaran.com) or the Mowimax app, you agree to be bound by these Terms of Use and our Privacy Policy. These Terms form a binding legal agreement between you (the “User”) and Mowimax (“we”, “us”, or “our”). If you do not agree with these Terms, you must not use our services.

1. Definitions

  • Account Information: Your personal and contact information required to use our Services.
  • Affiliates: Mowimax’s employees, officers, agents, subsidiaries, partners, and service providers.
  • App: The official “Mowimax” application available on compatible devices.
  • Authorized Devices: Devices like mobile phones, tablets, TVs, or desktops that support the Mowimax App or Website.
  • Authorized Users: Users with a valid subscription plan, including any eligible trial users.
  • Content: All media made available by Mowimax including movies, series, music, and documentaries.
  • Personal Information: Any data related to an individual as defined under applicable privacy laws.
  • Profile: Your user account on the Mowimax platform.
  • Services: All content, features, and functionalities offered via the Mowimax Website or App.
  • SPD (Sensitive Personal Data): Sensitive user data such as biometric or health information, defined under IT Rules or applicable privacy regulations.
  • User/You: Anyone who accesses or uses the Mowimax services or contributes to the platform.

2. Terms of Services

a. Introduction to Service Features

Mowimax provides personalized content and entertainment services through our website and mobile app for your personal use. By using our services, you agree to comply fully with these Terms and applicable laws. We may offer content recommendations and resume playback features to improve your experience.

b. Creating a Profile

To access our services, you must create a user profile by providing accurate and up-to-date information. By registering, you consent to the collection and use of your information as outlined in our Privacy Policy. We may collect details such as your location, language, and preferences to offer a more personalized experience.

c. Access to Content

Content is available to users with an active subscription (or eligible free trial) via the Mowimax Website and App. If you are under the legal age in your region, you must access our services under the guidance of a parent or legal guardian, who will be deemed responsible for your use.

Some content may not be appropriate for minors. Parental discretion is advised. We may display age-appropriateness indicators or disclaimers for such content to assist in your decision-making.

d. User License

Mowimax grants you a limited, non-transferable, non-exclusive license to access and use the content and services for personal, non-commercial purposes only.

Access to content may vary based on your region, device capabilities, internet availability, and other technical parameters. We may use technology to verify your location to comply with legal and licensing requirements.

You must not:

  • Copy, distribute, or make derivative works of our content without written permission

e. Compatible Systems

The services are available on supported devices and browsers. Compatibility may change based on third-party platform updates or manufacturer changes. Mowimax reserves the right to remove app access from any device without prior notice.

Mobile App Requirements:

f. User Responsibilities

You are responsible for using Mowimax legally and respectfully. You agree not to misuse, download, or share content without permission. Public sharing, copying, or broadcasting of any content is not allowed.

You will not upload or share harmful, offensive, or illegal material, impersonate others, or collect user data. Mowimax is not responsible for service interruptions caused by events beyond our control (e.g., natural disasters, technical issues, etc.).

g. Posting Content

Users must not post or transmit any content that is abusive, offensive, unlawful, or violates intellectual property rights. Do not impersonate others or upload content you do not own.

Content involving minors, violence, hate, or harassment is strictly prohibited. Mowimax reserves the right to remove inappropriate content and take necessary action.

h. General Usage Policy

  • Do not collect or misuse other users' data or platform content.
  • Do not overload the system with excessive requests or automated tools (bots, spiders, etc.).
  • Do not bypass content filters, geo-restrictions, or security systems.
  • Do not promote or link to competing services.

Any misuse may result in access restrictions or account termination.

i. Free Trials

Free trials may be offered at the sole discretion of Mowimax. The availability, duration, and content during the free trial period may change or be revoked without notice.

j. Subscription Fees

To access premium content, you may need to subscribe and pay applicable subscription fees. Plans may include:

  • Free plans with ads
  • Paid subscriptions (with or without ads)
  • Pay-per-view content

Features, fees, and content availability are subject to change. Some plans may have limitations based on region, devices, or concurrent usage.

Additional features (Add-ons) may be offered for extra charges. Personal data collected during registration or use is handled in accordance with our Privacy Policy.

k. Payment

You can pay for subscriptions using available payment methods like credit/debit cards or net banking. Subscriptions auto-renew unless cancelled before the current period ends or before the free trial ends (if applicable).

Subscription changes apply after the current period expires. You may cancel anytime from your account section, but payment methods can't be changed during an active subscription. If your payment fails or the method is unavailable, your access may be suspended until payment is completed.

Subscription fees include applicable taxes (for Indian users) and are non-refundable after 7 days of purchase, especially if premium content has been accessed. Payments are processed via secure third-party gateways, and Mowimax is not liable for gateway delays or fraud. Contact support for any payment issues.

Invoices are available in your account under “Settings” and can be downloaded in PDF format. Offers, benefits, or rewards may be introduced at Mowimax’s discretion and may have specific conditions.

l. Non-Compliance

In case of rule violations or misuse of the platform, Mowimax reserves the right to:

  • Suspend or restrict your account
  • Remove any non-compliant content
  • Limit benefits or privileges
  • Forfeit or request refund of any earned fees

m. Cancellation of Services

If you cancel services after requesting them, Mowimax may apply a cancellation fee. This charge may be deducted from your current payment or billed with your next service usage.

n. User Consent to Use Information

By using our Services, you acknowledge and consent to the collection and sharing of your personal information in accordance with our Privacy Policy.

o. User Representations and Warranties

You confirm and agree that:

  • You are either an adult or using the Services under the supervision of a legal guardian.
  • You will not misuse the Services or access content and user information beyond its intended purpose.
  • You will not attempt to gain unauthorized access to the Website/App, servers, or related systems.
  • You will not use the Services in a way that harms or disrupts the platform or infringes on intellectual property rights.
  • You will not re-sell, license, or commercially exploit any part of Mowimax without written consent.
  • You will not reverse-engineer, copy, or replicate our Services or infrastructure.
  • You will not disable or interfere with ads, content, or platform functionalities in any way.

3. Registration / Creation of Profile

a. Account Creation and Deletion

To use our Website/App and Services, you must create an account and provide accurate personal information. You can delete your account at any time through the settings in the Website/App.

However, we may retain certain information as required under our Privacy Policy.

By registering, you confirm that:

  • All information you provide is true, complete, and accurate.
  • You will keep your information updated and accurate at all times.

b. User Responsibilities

You are responsible for maintaining the confidentiality of your login credentials and all activity that occurs under your account. If you suspect unauthorized access, you must notify us immediately at support@mowimax.com. We will assist you in securing your account.

4. Access to the Website and App

a. Usage Restrictions

Your access and rights are limited as follows:

  • You may not copy, reproduce, distribute, sell, or modify any part of the content or services without permission.
  • You may not reverse-engineer, decompile, or tamper with the Website, App, or services.
  • You may not use any information or content to build a competing service or platform.
  • All future updates and features are subject to these terms and applicable copyright laws.

b. Modification, Suspension or Discontinuation

We may temporarily or permanently suspend, modify, or discontinue any part of the Website/App or Services for technical, legal, or business reasons without prior notice. We are not liable for any impact this may have on your access or usage.

c. No Support or Maintenance Obligation

For support queries, contact us at support@mowimax.com. However, we are not obligated to provide real-time or continuous support or maintenance unless otherwise stated in our Privacy Policy.

d. Ownership

Except for your account information, all rights to the Website, App, content, services, and related intellectual property belong to Mowimax or its licensors. These rights remain in effect globally and indefinitely.

You are granted a limited license to use the Website and App under these terms. No intellectual property rights are transferred to you.

5. Provided Information & Acceptable Use Policy

a. Risks

You confirm that the account or other information you share with us (including via email or our support form) does not violate the Acceptable Use Policy below. You are solely responsible for the accuracy and legality of your information.

Mowimax is not responsible for any loss or deletion of such data and is not obligated to keep backups of your submissions. Sharing false, misleading, or harmful content may make you legally liable.

b. Acceptable Use Policy

You agree not to use the Website/App or Services to upload, transmit, or share any content that:

  • Violates any laws or third-party rights (e.g., copyright, privacy, or trademarks).
  • Contains hate speech, pornography, defamation, violence, or offensive material.

In addition, you must not:

  • Upload viruses, malware, or harmful code.
  • Send spam, junk mail, or unauthorized promotional content.
  • Harvest or collect personal data about other users without consent.
  • Interfere with the operation of our systems or security.
  • Attempt to gain unauthorized access to other accounts or data.
  • Create multiple accounts or use bots to misuse the platform.
  • Harass, disrupt, or negatively affect other users’ experience.

c. Enforcement

Mowimax reserves the right to review user content and take action in case of violations. This may include:

  • Removing or editing your content.
  • Suspending or deleting your account.
  • Reporting unlawful activity to authorities.

We may share your data with law enforcement or regulators when required to (a) comply with legal obligations, (b) enforce our Terms, (c) support user requests, or (d) protect Mowimax and its users.

d. Feedback

If you share suggestions, ideas, or feedback with us, you agree that Mowimax has full rights to use it in any way. Such feedback will be treated as non-confidential and non-proprietary.

6. Indemnification

By using the Mowimax website, app, services, or content, you agree to indemnify and hold harmless Mowimax, its affiliates, and licensors from any claims, losses, or liabilities (including legal fees) arising out of:

  • Your use of our platform;
  • Your violation of these Terms or our Privacy Policy;
  • Your violation of any applicable law or regulation.

We may, at your expense, assume control of any matter requiring indemnification, and you agree to cooperate. You may not settle any such matter without our written consent.

7. Release

To the extent permitted by law, you release Mowimax and its affiliates from all past, present, and future claims or disputes related to our platform or services—including any issue involving other users, third-party ads, or links. If you have a dispute with another user, you release us from all related liabilities.

8. Disclaimer of Warranties

You use the Mowimax website/app and services at your own risk. We provide all content and services "as-is" and "as available" without warranties of any kind—express, implied, or statutory.

We do not guarantee the reliability, availability, accuracy, or safety of our services, or any linked third-party sites or ads. We are not liable for issues like service interruption, data loss, or system damage.

9. Limitation of Liability

To the fullest extent permitted by law, Mowimax and its affiliates are not liable for any direct, indirect, incidental, or consequential damages—including lost profits or data—arising from your use of our platform, even if we’ve been advised of the possibility. You use the platform at your own risk.

10. Third-Party Links & Advertisements

a. Third-Party Links

Mowimax may display external links and third-party ads. We are not responsible for their content, services, or any transactions you make with them. Use such links at your own discretion and refer to their respective terms and privacy policies.

b. User’s Note

We are not responsible for any losses resulting from your interactions with other users or the manipulation of your account or information. We are under no obligation to resolve disputes between users.

11. Term and Termination

These Terms apply while you use Mowimax. We may terminate or suspend your access to the website/app at any time. Upon termination, your profile and data may be deleted, and we are not liable for any resulting loss.

Even after cancellation, we may contact you for marketing or service-related purposes as per our Privacy Policy—even if you're on a Do Not Disturb (DND) list.

12. General

a. Electronic Communication

You consent to receive all communications electronically (email, calls, texts, WhatsApp, etc.) as described in our Privacy Policy.

b. Waiver

Our failure to enforce any right does not waive it. Any waiver must be in writing.

c. Interpretation

Section titles are for convenience. "Including" means "including without limitation."

d. Severability

If any part of these Terms is found invalid, the rest will remain effective. Invalid parts may be modified to remain lawful.

e. Relationship

You agree there is no employment, agency, or partnership relationship between you and Mowimax.

f. Assignment

You may not transfer your rights under these Terms. We may assign ours freely.

g. Governing Law and Jurisdiction

These Terms are governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts in Singapore.
